ملاحظات نقدية على قانون منع اساءة استعمال اجهزة الاتصالات رقم (6) لسنة 2008 فی اقلیم كوردستان-العراق

Abstract
This research is summed up in shedding light on formal and substantive legal observations on the Law on Preventing Misuse of Communications Equipment No. (6) of 2008 in the Kurdistan Region - Iraq. Which was initiated in light of the tremendous development that the region has developed recently in the field of using modern electronic device technologies, including different means and devices of communications. The reason for legislating a special law to prevent the misuse of modern communications devices is the spread of many crimes that are considered traditional crimes in themselves, but they are committed by modern means and electronic devices, and some crimes are new and did not exist before and are not addressed by the penal laws in force in the region.\r\nDespite the positive side of this law, it is not devoid of negatives, whether in terms of form and drafting or in terms of subject and content. In addition, it brought about a kind of contradiction and repetition between its texts and the punitive texts found in the applicable Penal Code.\r\nThrough research, we tried to identify valuable observations on the law, identify its weak points, and suggest alternatives to them, in order to pave the way for keeping the region’s law in line with the legislation of developed countries in addressing the misuse of modern communications devices, and reducing the crimes committed through these devices in order to preserve community security and safety and protection of the family entity in the region.
