Misyar Marriage Between Sharia and Reality: A Critical Reading of Its Legal and Social Consequences

In social and legal systems, the family is the foundational pillar of societal stability. In Islam, the marital relationship is considered a sacred covenant (Al-Mithaq Al-Ghaleeth), established on the principles of tranquility, love, and shared responsibility, as stated in the Holy Quran: "And among His signs is that He created for you mates from among yourselves that you may find tranquility in them; and He placed between you affection and mercy." (Ar-Rum: 21) However, with the increasing complexity of contemporary life and the emergence of economic and social crises, several non-traditional forms of marriage have surfaced. Foremost among them is Misyar marriage (convenience marriage), which is the subject of extensive legal and Sharia debate. From an academic perspective, this article endeavors to shed light on the essence of this marriage and its negative impacts on the family structure.
